Certificate of Compliance (Smoke & CO detector/Fire ext.)


The Code Enforcement Department is responsible for processing applications for smoke, carbon monoxide detectors, and portable fire extinguisher inspections (Certificate of Compliance), in accordance with the requirements set forth in N.J.A.C. 5:70-4.19 and 52:27D-198.1, for all re-occupancy or continued occupancy by means of re-rental or re-sale of all one and two residential dwelling units located in the Town.  Once the COC application is finalized by the Code Enforcement Department it will be forwarded to the Deputy Code Enforcement Official for the scheduling of the COC inspection.

COC (Smoke & CO detector/Fire Ext.) Application Process


Applications will be considered finalized and released for inspection only when the following criteria have been met:
  • Full payment is received via cash or check only (check payable to "Town of Newton").  See bottom of COC application for fee schedule.
  • All open permits or code violations have been closed.  Arrangement to close building permits must be made with the Hardyston Construction Department at 973-823-7020.  Once all permits and violations are closed, the COC application will be processed.  The COC will be determined using the date all permits were closed as the starting date.
  • Applications processed on Fridays or after 12 noon of the current business day will not be finalized and released for inspections until the next business day, provided the above criteria have been met.
  • Completed COC applications can be delivered in person to the Code Enforcement Office on the ground floor of the Municipal Building during Code Enforcement hours, sent by USPS to 39 Trinity St., Newton, NJ (Attn: Code Enforcement - COC App.) or placed in after-hours drop box outside the street level entrance.
Upon compliance, the property owner will be issued a Certificate of Compliance with a copy retained in the Code Enforcement Office.  The certificate is valid for six months from the date of the inspection approval.
